Terms and Conditions of Sale

Article 1 – Purpose

These General Terms and Conditions of Sale (hereinafter the "GTC") govern the sale of products concluded remotely on the website www.rizpoli.fr, operated by Riz Poli Cooperation.

Any order placed on the website implies the unreserved acceptance of these GTC by the customer.

Article 3 – Products

The products offered for sale are those presented on the website, within the limits of available stock.

Riz Poli Cooperation strives to present and describe the products with the greatest possible accuracy. However, minor variations may appear between the photographs, visuals, colors displayed on screen and the products actually delivered, particularly due to display settings, lighting, or the nature of the materials used.

Article 4 – Prices

Prices are indicated in euros (€), all taxes included (TTC), unless otherwise stated, excluding delivery costs.

Applicable delivery costs are indicated to the customer before the final validation of the order.

Riz Poli Cooperation reserves the right to modify its prices at any time. However, products are invoiced on the basis of the rates in force at the time of order validation.

Article 5 – Order

The customer selects the products they wish to purchase and adds them to their cart.

Before final validation of the order, the customer can check the details of their order, its total price, correct any errors, and read these GTC.

The order is definitively registered after payment validation. The customer acknowledges that the final validation of the order implies an obligation to pay. In France, this information must be clearly brought to the customer's attention before the final click.

An order confirmation email is then sent to the customer.

Article 6 – Payment

The price is payable in full on the day of the order.

Payment is made by the payment methods offered on the website at the time of the order, including: bank card, Apple Pay, Shop Pay, PayPal or any other method offered in the Shopify payment interface.

Riz Poli Cooperation reserves the right to suspend or cancel any order in case of payment default, payment incident or suspicion of fraud.

Article 7 – Delivery

Products are delivered to the address provided by the customer during the order.

Delivery is offered worldwide, with the exception of China.

Delivery times are indicated for information purposes on the website or at the time of order. Riz Poli Cooperation undertakes to ship orders within a reasonable time frame in accordance with the legal obligations applicable to distance selling. French regulations require the professional to indicate and adhere to a delivery time.

The customer is required to check the condition of the package and products upon receipt and to report any anomaly without delay to the carrier as well as to Riz Poli Cooperation at boutique@rizpoli.fr.

Article 8 – Right of withdrawal

In accordance with the Consumer Code, the consumer customer has a period of fourteen (14) calendar days from the day after receipt of the product to exercise their right of withdrawal, without having to give reasons for their decision.

To exercise this right, the customer must notify their decision by email to boutique@rizpoli.fr by means of an unambiguous statement.

The customer must then return the product(s) concerned within a maximum period of fourteen (14) days following the sending of their decision to withdraw.

Products must be returned:

  • unworn,

  • unwashed,

  • undamaged,

  • in their original condition,

  • with their original labels and packaging, if applicable.

The direct return costs remain the responsibility of the customer. This information must be communicated to the customer before the sale.

The reimbursement of sums paid by the customer, including initial standard delivery costs, is made within a maximum period of fourteen (14) days from the date on which Riz Poli Cooperation is informed of the decision to withdraw. However, reimbursement may be deferred until the goods are recovered or until receipt of proof of shipment provided by the customer, the date taken being that of the first of these events.

Article 9 – Exceptions to the right of withdrawal

In accordance with applicable legal provisions, the right of withdrawal cannot be exercised for products:

  • made to the customer's specifications,

  • clearly personalized,

  • or made to order.

Consequently, personalized products, modified at the customer's request, special orders or custom-made items are neither returned nor exchanged.

Article 10 – Discounted, reduced, archive or promotional products

Products offered at a reduced price, on promotion, in archive sale, sample sale, clearance sale or sales remain subject to the mandatory legal provisions applicable to distance selling when sold to consumers.

Consequently, when a legal right of withdrawal applies, it remains applicable even for a discounted product, unless there is a legal exception provided for in Article 9. Distance purchases of discounted products cannot be automatically excluded from the right of withdrawal.

Article 11 – Exchanges and refunds outside of withdrawal

Outside the exercise of the legal right of withdrawal or a legal guarantee, no exchange or refund will be accepted for products returned incomplete, worn, washed, damaged, soiled or rendered unfit for re-marketing.

Riz Poli Cooperation reserves the right to refuse any refund or to apply, where permitted by law, a justified reduction corresponding to the depreciation of the goods resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the product.

Article 12 – Legal guarantees

The customer benefits from the legal guarantee of conformity as well as the legal guarantee against hidden defects, under the conditions provided by French law.

No clause in these GTC can deprive the consumer of their legal rights in this respect.

Article 13 – Liability

Riz Poli Cooperation cannot be held responsible for the non-performance or improper performance of the contract in the event of:

  • an act attributable to the customer,

  • an unforeseeable and insurmountable act of a third party,

  • or force majeure as defined by French law and jurisprudence.

Article 14 – Personal Data

Information relating to the collection and processing of personal data is detailed in the Privacy Policy available on the website.

Article 15 – Complaints and consumer mediation

In case of dispute, the customer must first send a written complaint to:

Failing a prior amicable solution, the consumer customer can resort free of charge to a consumer mediator. The professional must designate a mediator referenced by the CECMC and communicate their contact details to consumers.

Riz Poli Cooperation has chosen as consumer mediator:

The consumer can refer to this mediator after having sent a prior written complaint to Riz Poli Cooperation and in the absence of an amicable resolution of the dispute.

Article 16 – Applicable law and competent jurisdiction

These GTC are subject to French law.

In case of dispute, and failing an amicable resolution or mediation, the French courts will be competent, subject to the mandatory protective legal provisions applicable to the consumer.
